LIEN WAIVER COMPLIANCE

Understanding Waiver Types

Navigate payment milestones with clarity. Protect your property rights and release liability correctly through strategic compliance procedures.

Ongoing Billing

Conditional Progress

Issued alongside an active progress pay application. Waives lien rights only after the specific check or ACH payment clears your account.

Payment Cleared

Unconditional Progress

Issued after a progress payment has cleared the bank. Confirms full release of lien rights for work through the stated period date.

Final Billing

Conditional Final

Submitted with your final project pay application or retainage billing. Waives all remaining lien rights once the final check clears.

Project Closed

Unconditional Final

Full and final release confirming all project payments and retainage have cleared. Formally concludes all lien rights on the property.

Common Questions

Does my waiver require notarization?

Statutory forms for Georgia and Mississippi have specific affidavit rules, while standard commercial waivers generally do not require notarization unless specifically requested by your contract or lender.

The "Through Date" must match the ending date of the billing cycle covered by your current pay application, not the date you sign the document.

If your project has owner- or lender-specific release requirements, contact your NM&C project team directly for guidance.
